Introduction
These Terms & Conditions ("Terms") govern your access to and use of the One Menu platform, including our website at onemenu.pk, our dashboards, mobile applications, ordering interfaces, and related software and services (together, the "Services"). The Services are operated by OneMenu Pvt Ltd, a company registered in Pakistan with its registered office at 278, Jalilabad Colony, Multan, Pakistan ("One Menu", "we", "our", or "us").
By registering for, accessing, or using the Services, you agree to be bound by these Terms. If you do not agree, you must not use the Services.
These Terms apply to restaurant owners and businesses that subscribe to One Menu ("Merchants"), their staff, sub-merchants operating white-label applications, and end customers who place orders through One Menu-powered channels.
Definitions
- Merchant — a restaurant, business, or individual that subscribes to and operates One Menu.
- Sub-Merchant — a business operating a white-label application powered by One Menu that accepts payments through our integrated payment facilities.
- Customer — an end user who places an order or makes a payment through a One Menu or Sub-Merchant channel.
- Order — a request for goods or services placed through the Services.
- Payment Gateway — the third-party payment processing facility integrated with the Services to collect Customer payments.
Accounts & Eligibility
To use the Services you must be at least 18 years of age and legally capable of entering into a binding contract. You agree to provide accurate, current, and complete information during registration and to keep it up to date.
You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. You must notify us immediately of any unauthorized use. We are not liable for any loss arising from your failure to safeguard your credentials.
Subscription & Fees
One Menu is offered on a subscription basis. Subscription fees, billing cycles, and the features included in each plan are described on our website and may be updated from time to time. By subscribing, you authorize us to charge the applicable fees for your selected plan.
- Subscription fees are billed in advance for each billing period and are stated in Pakistani Rupees (PKR).
- Unless stated otherwise, subscriptions renew automatically until cancelled by you.
- You may cancel your subscription at any time; cancellation stops future renewals but does not, by itself, entitle you to a refund of fees already paid, except as set out in our Refund Policy.
- We may change our fees on reasonable prior notice. Continued use after a fee change constitutes acceptance of the new fees.
Payments, Orders & the Payment Gateway
The Services enable Merchants and Sub-Merchants to accept payments from Customers for Orders through an integrated Payment Gateway. When a Customer pays for an Order:
- One Menu facilitates the transaction between the Customer and the relevant Merchant or Sub-Merchant. The Merchant or Sub-Merchant is the seller of the goods or services and is responsible for fulfilling the Order.
- Payments are processed by licensed third-party payment processors and banks. We do not store complete card details.
- Funds collected on behalf of a Merchant or Sub-Merchant are settled to them in accordance with the applicable settlement schedule, net of any fees.
- Refunds for Orders are handled in accordance with our Refund Policy.
One Menu provides the technology that enables payment collection and order management. Responsibility for the quality, accuracy, delivery, and lawfulness of the goods and services sold rests with the Merchant or Sub-Merchant, not with One Menu.
Merchant & User Responsibilities
As a user of the Services, you agree that you will:
- Use the Services only for lawful business purposes and in compliance with all applicable laws of Pakistan;
- Accurately represent your menu, prices, availability, and order details to Customers;
- Fulfil accepted Orders and honour refunds and claims in line with our Refund Policy;
- Obtain any necessary consents from your staff and Customers for the processing of their data;
- Not use the Services to sell prohibited, counterfeit, or illegal goods or services.
Acceptable Use
You must not, and must not permit others to:
- Attempt to gain unauthorized access to the Services, other accounts, or our systems;
- Reverse engineer, copy, resell, or create derivative works of the Services except as permitted by law;
- Introduce viruses, malware, or any code intended to disrupt the Services;
- Use the Services to transmit unlawful, fraudulent, or abusive content;
- Interfere with or place undue burden on our infrastructure.
We reserve the right to investigate and take appropriate action against anyone who violates this section.
Intellectual Property
All rights, title, and interest in and to the Services — including the software, design, logos, and content we provide — remain the property of OneMenu Pvt Ltd or its licensors. We grant you a limited, non-exclusive, non-transferable licence to use the Services for your business during your subscription.
Content you upload (such as your menu, branding, and business data) remains yours. You grant us a licence to host, process, and display that content solely to provide the Services to you.
Data & Privacy
Our collection and use of personal information is described in our Privacy Policy, which forms part of these Terms. By using the Services you consent to the processing of information as described there.
Service Availability & Support
We aim to keep the Services available at all times but do not guarantee uninterrupted or error-free operation. The Services may be temporarily unavailable for maintenance, updates, or reasons beyond our control. We provide support to Merchants through the contact channels listed on our website.
Limitation of Liability
To the maximum extent permitted by law, One Menu shall not be liable for any indirect, incidental, special, or consequential damages, or for loss of profits, revenue, data, or business, arising out of or in connection with your use of the Services.
Our total aggregate liability arising out of or relating to the Services shall not exceed the total subscription fees paid by you to us in the three (3) months preceding the event giving rise to the claim.
Nothing in these Terms excludes liability that cannot be excluded under applicable law.
Indemnification
You agree to indemnify and hold harmless OneMenu Pvt Ltd, its directors, employees, and partners from any claims, damages, losses, or expenses (including reasonable legal fees) arising out of your use of the Services, your breach of these Terms, or your violation of any law or the rights of a third party, including Customers.
Suspension & Termination
We may suspend or terminate your access to the Services if you breach these Terms, fail to pay applicable fees, or engage in activity that may harm the Services, other users, or us. You may stop using the Services and cancel your subscription at any time.
On termination, your right to use the Services ends. We may retain and delete your data in accordance with our Privacy Policy and applicable law.
Governing Law
These Terms are governed by and construed in accordance with the laws of the Islamic Republic of Pakistan. Any dispute arising out of or in connection with these Terms shall be subject to the exclusive jurisdiction of the courts of Multan, Pakistan.
Changes to These Terms
We may update these Terms from time to time. When we make material changes, we will update the "Last updated" date above and, where appropriate, notify active subscribers. Continued use of the Services after changes take effect constitutes your acceptance of the revised Terms.
